The decision of the Central District Court in Seoul paves the way to release the prison leader.

The South Korean court overturned the impected arrest warrant of President Ion Suk-Jal, making the way to release him from prison after he was detained for martial law.

The eliminated president filed a request to the Central District Court in Seoul last month, pleading that the arrest warrant issued against him was illegal.

“It is reasonable to conclude that the indictment was filed after the expiration of the defendant's detention period,” a document from the Central District Court in Seoul said.

“In order to ensure procedural clarity and to eliminate any doubts about the legality of the investigation process, it would be appropriate to issue a decision to cancel the detention,” the court added on Friday.

“The law of South Korea is still alive,” said Ion's legal advisor following the court's ruling, according to South Korean television operator YTN.

Local media have stated that Ion is expected to be released and participate in his trial while beyond the detention.

However, Seok Dong-Haheon, Yon's lawyer, said prosecutors could still appeal the court's decision.

“Yoon is held just over 50 days in a south of Seoul, almost after his arrest in mid -January,” said Rob McBride to Al Jazeera, reporting from the capital of South Korea.

“This remains a question whether (Yoon) will be released later this Friday, which is an expectation or whether prosecutors in this case will appeal this, in which case the detention will continue,” he added.

Rebellion

South Korea's presidential service welcomed the court's decision on Friday, saying that he hoped Ion would return to work soon.

The weakened president was arrested in mid -January onwards uprising over its brief imposition of martial law weeks earlier.

Yoon's attorneys say the arrest warrant issued on January 19, which kept it in place, is invalid because the request filed by prosecutors is procedurally insufficient.

Ion declared martial law on December 3, saying that it was necessary to eradicate “antistal” elements, but canceled a decree six hours later after parliament voted to reject it. He said he had never intended to impose a completely emergency military government.

Weeks later, he was hindered by the opposition-led parliament on accusations of violating his constitutional obligation by declaring martial law.

It now depends on the Constitutional Court to decide whether to officially terminate the Presidency of ION or to restore it. If the Constitutional Court supports the impeachment, it will be officially disposed of and the national elections will be held to choose its heir within two months.

The 64 -year -old Ion is also facing a separate criminal process and became the first sedentary president to be arrested on criminal charges on January 15th.
