The sentence, announced on Tuesday, found that Jackie Chen was guilty, although a different court acquitted her in 2020. The case was considered after appealing the Hong Kong Justice secretary, emphasizing the continuous counteraction to political affairs in Chinese territory.
Chen said she sought during the protests to mediate between police and protesters, using a speaker to summon the police to stay calm and not use her weapons.
However, prosecutors claim that Chen is actively involved in rebellion.
She admitted that she was not guilty, but the Deputy Judge May Chung decided that Chen made unfounded accusations against the police by calling “provocative” words that suggest they used excessive power.
“Through his words and actions (Chen), he expressed his support to the protesters … which strengthened their determination and confidence to oppose the police,” the judge wrote.
Before the sentence, Chen told reporters that she had no regret and had spent five years preparing for the result.
“I hope that all the people I know will live healthy, they will live happy because we still have our way to go together,” she said.
After the decision, she reassured her supporters in the public gallery, shouting that she would be fine. It must be sentenced in April.
While the Hong Kong Act allows a maximum 10-year conviction for riots, district court decisions are limited to seven years.
The case caught the attention of CH's limited role in the 2019 democracy protests, which has sparked Beijing's most challenge to Hong Kong since the 1997 city broadcast by its former colonial ruler, the United Kingdom.
The protests began over the proposed extradition bill. She was later withdrawn, but protests escalated in broader calls for democracy and police accountability.
Beijing responded with an extensive national security law, which led to the persecution of many activists. Authorities say the law has restored stability.
Last year convicted 45 Democracy activists until prison up to 10 years on the first mass sentence, as Beijing imposed the law.
