The Federal District Judge in Maryland found that Elon Musk and its Ministry of Government Government (Dogi) seem to have violated the United States Constitution through their efforts to dismantle an agency dedicated to the spread of foreign assistance.
Judge Theodor Chuang issued a preliminary decision on Tuesday, in response to a complaint filed by 26 employees and contractors for US Agency for International Development (USAID).
“The court finds that the actions of the defendants undertaken to close USAID on an accelerated basis, including its obvious decision to permanently close the USAID plant without approval of a duly appointed USAID employee, probably violated the United States Constitution in many ways,” Chuang wrote in his decision.
Not only the claimants are harmed, he added, but also the “public interest”.
Dog and Musk “deprived the elected public representatives in the congress of their constitutional body to decide whether when and how to close an agency created by the congress,” Chuang said.
As a result of this finding, the judge approved a temporary order that would prevent Dog and Musk from continuing with the reduction of USAID -related staff, cancellation of contracts, closing buildings and destroying USAID materials.
“Restrictions will help maintain the status quo to slow down the premature, final USAID suspension,” Chuang wrote.

A technical billionaire and one of the most rich men in the world, Musk is considered a “special civil servant”, a temporary role, often given to external advisers.
In this role, however, it leads to a huge campaign to restructure the federal government by reducing its workforce, termination of contracts and attempting to close entire agencies.
USAID was one of the first to cross Doge. After entering office for a second term on January 20, Trump issued a president order calling for a 90-day freezing of all foreign assistance – Central of USAID work.
Established in 1961 by an act of Congress, USAID has become the main hand of the United States for the spread of foreign assistance abroad.

In order to justify redundancies in the government, Musk and Trump have repeatedly accused departments and agencies of having carried out “waste” and “fraud” without suggesting evidence.
Given that USAID was established as an independent agency under the Congress Foreign Aid Act, Judge Chuang decided that Musk's actions “probably violate the constitutional principle of separation of powers”.
As part of the order on Tuesday, Chuang required Doge to restore the access of USAID employees to electronic systems and urged the department to restore all deleted emails.
However, Trump's allies quickly struck Chuang, appointed to former President Barack Obama – for his temporary order.
